When you set out to file a patent or assess whether an invention is truly novel, your first question is: where do I look? The answer is rarely a single place. Patent information is scattered across national offices, multilateral databases, private commercial platforms, and even scientific journals – each serving a different purpose depending on what you need to know. Understanding these sources, their scope, and how to use them is a foundational skill for any inventor, IP professional, or student navigating the world of patents.

Why the source of patent information matters
A patent search is only as good as the sources it draws from. The objective of the search determines where you look. If you’re assessing the state of the art in a technology field, you need broad international coverage. If you’re evaluating patentability before filing, you need prior art from as many jurisdictions as possible. If you’re conducting a freedom-to-operate (FTO) analysis or supporting litigation, you may also need to verify legal status, ownership history, and non-patent publications. No single database covers all of this – which is why knowing your sources is critical.
Free public patent databases
The most accessible starting point for any patent search is the collection of free databases maintained by major patent offices and international organisations. These are publicly available, regularly updated, and authoritative by design.
USPTO – the United States Patent and Trademark Office
The USPTO’s Patent Public Search tool replaced older systems like PatFT and AppFT and now allows users to search both granted patents and published applications simultaneously. It supports complex Boolean and proximity searches, and covers full-text US patents from 1970 onwards, with classification-based searches going back to 1790. For those interested in patent family data and file histories across multiple offices, the Global Dossier – also offered by USPTO – provides access to related applications from the five largest IP offices worldwide (the IP5: USPTO, EPO, JPO, KIPO, and CNIPA). This is especially useful when tracking how the same invention has been filed internationally.
EPO Espacenet
Espacenet, operated by the European Patent Office, is one of the most comprehensive free databases available globally. It indexes over 154 million patent records from more than 90 offices worldwide, going back to the 1800s for some collections. Crucially, Espacenet supports classification-based searching using both the International Patent Classification (IPC) and the Cooperative Patent Classification (CPC) systems – tools that allow users to find patents in a specific technology area even when the terminology varies. Espacenet also links records to the INPADOC database, which tracks legal status and patent family information. For users working in chemistry or biotechnology, Espacenet’s search reports are particularly valuable: more than half of all EPO search reports in these fields include citations to non-patent literature, offering an integrated view of patent and scientific knowledge in a given area.
WIPO PATENTSCOPE
WIPO’s PATENTSCOPE is the go-to resource for searching international patent applications filed under the Patent Cooperation Treaty (PCT). It provides full-text access to PCT applications on the day of publication, covers over 73 million patent documents across national and regional collections, and includes an AI-based translation tool supporting 13 languages. For Indian applicants targeting international markets, PATENTSCOPE is often the first database to consult when assessing whether a PCT filing makes strategic sense – it reveals what competing inventions have already been filed internationally and in which jurisdictions protection has been sought.
InPASS – Indian Patent Advanced Search System
For searches focused on India-specific patents, InPASS (Indian Patent Advanced Search System), maintained by the Indian Patent Office under the Controller General of Patents, Designs, and Trademarks (CGPDTM), is the most reliable source. Introduced in 2015 to replace the earlier IPAIRS system, InPASS allows full-text searches of granted patents and published applications using keywords, application numbers, IPC codes, applicant names, and filing dates. It also supports wildcard and Boolean operators. Importantly, InPASS provides real-time access to the legal status of patents through its E-Register and Application Status features. While paid databases can sometimes lag in reflecting the latest Indian filings, InPASS remains the most authoritative tool for retrieving current Indian patent data. However, InPASS does have limitations – the system does not always support complex multi-field Boolean strings within a single entry, so building a layered search strategy across multiple queries is recommended.
Other national and regional offices
Beyond these primary databases, several other national offices offer free searchable databases. These include the Japan Patent Office (JPO), which provides machine translations of Japanese patents, the China National Intellectual Property Administration (CNIPA) with machine-translated Chinese patents, and the Korean Intellectual Property Rights Information Service (KIPRIS). For Latin American jurisdictions, the LATIPAT project – a collaboration between WIPO, the Spanish Patent Office, and the EPO – covers 19 patent offices across Latin America and the Caribbean. These sources become relevant when your prior art search needs to extend beyond the major patent-filing jurisdictions.
Paid and value-added patent databases
Free databases are excellent starting points, but professional patent searches – particularly for litigation, licensing, or large-scale technology landscaping – typically involve paid databases that offer enhanced analytical features, cleaner data, and consolidated global coverage.
Some of the most widely used paid platforms include:
- Derwent Innovation (formerly Derwent Innovations Index): Published by Clarivate, Derwent is known for its manually enhanced patent abstracts and unique family identifiers that allow searchers to track inventions across global filings without duplicate counting. It covers chemical, electrical, electronic, and mechanical engineering in particular depth.
- Questel Orbit: A comprehensive analytics platform that combines patent data with market intelligence, citation networks, and competitive landscape tools. Widely used in corporate IP departments.
- PatSeer: Offers patent search, analytics, and NPL integration with download capability and trend analysis across jurisdictions.
- PatBase: Focuses on patent family data and is widely used for freedom-to-operate analysis.
- PATSTAT (EPO World Patent Statistical Database): Developed by the EPO, PATSTAT contains around 90 million patent records with bibliographic data, citation information, and family links. It is the benchmark database for large-scale patent statistics and academic research. It is available on subscription and requires SQL knowledge for effective use.
The choice between paid and free databases comes down to the depth of analysis required. For routine patentability searches, free databases are often sufficient. For due diligence in M&A transactions, patent portfolio valuations, or invalidity proceedings, the enhanced data quality and analytical tools of paid platforms become indispensable.
Non-patent literature (NPL) as a source of patent information
One of the most frequently overlooked categories in patent searching is non-patent literature (NPL) – a broad term for any published document that is not a patent or patent application but is relevant to the state of the art. This includes scientific and technical journals, conference proceedings, academic theses and dissertations, government and institutional reports, technical standards (ISO, IEC, IEEE), books, and even websites and press releases.
Why NPL is essential, not optional
NPL matters because it constitutes valid prior art. Since NPL is typically published before the corresponding patents – which take 12 to 24 months from filing date to publication – it can reveal prior disclosures that would defeat a patent application long before those disclosures appear in any patent database. This is especially significant in fields like biotechnology, pharmaceuticals, and artificial intelligence, where academic research precedes commercial patent activity by years.
The data bears this out. According to reporting by the EPO, in 2022, 28.7% of EPO search reports contained at least one NPL citation. In the fields of chemistry and biotechnology, more than half of all search reports cite NPL. Even beyond novelty assessment, NPL has been used as conclusive evidence in patent invalidity proceedings, including high-stakes litigation between major technology companies.
Types and sources of NPL
According to a framework adapted from the WIPO Standard ST.14, which governs the citation of references in patent documents, NPL types include peer-reviewed journal articles, monographs from quality publishers indexed in databases like Web of Science or Scopus, technical standards, and other materials such as technical reports, news articles, and websites. The format of citations in patent documents is regulated by this WIPO standard, ensuring a degree of consistency across patent offices.
Key databases and platforms for accessing NPL include:
- Google Scholar: A broad interdisciplinary index covering academic articles, preprints, theses, and court opinions. Free and widely accessible, making it an effective first stop for NPL searches.
- IEEE Xplore: Essential for electronics, computing, and electrical engineering literature.
- ScienceDirect / Springer / Wiley Online Library: Major publishers covering life sciences, chemistry, engineering, and more.
- Scopus and Web of Science: Subscription-based bibliometric databases that also allow citation tracking – useful for mapping how a scientific paper influenced subsequent patent activity.
- The Lens (lens.org): An open platform that integrates both patent and scholarly literature. The Lens links approximately 291.4 million scholarly works from PubMed, Crossref, and Microsoft Academic to patent citations, allowing users to move fluidly between scientific publications and the patents that cite them.
- Scifinder (CAS): Particularly valuable for chemical and pharmaceutical prior art, covering journal articles, patents, and substance data in an integrated environment.
Choosing the right source for your search objective
The appropriate combination of sources depends directly on what your search is meant to accomplish:
- Patentability or novelty search: Start with InPASS for Indian prior art, then extend to Espacenet or PATENTSCOPE for international coverage. Supplement with Google Scholar and relevant subject-specific databases for NPL, given that academic disclosures are valid prior art regardless of whether they appear in a patent database.
- State-of-the-art (technology landscape) search: Use broad international patent databases (Espacenet, PATENTSCOPE, Google Patents) combined with NPL to map where a technology stands globally. Paid databases like Derwent or Orbit add analytical layers for trend mapping.
- Freedom-to-operate (FTO) or infringement analysis: Requires precise legal status data. Espacenet’s INPADOC, USPTO’s Global Dossier, and InPASS E-Register for Indian patents are the primary sources. Paid databases with clean family data (PatBase, PATSTAT) are preferred for professional FTO opinions.
- Invalidity or opposition research: Demands the widest possible net across both patent databases and NPL. NPL is particularly critical here because it can surface prior art predating a patent’s filing date in the form of journal articles, conference papers, or technical disclosures that predate any patent publication on the same subject.
The evolving landscape of patent information access
Access to patent information has expanded dramatically over the last decade. Where searching once meant manually reviewing physical gazette publications – as was the norm for Indian patent searches before InPASS was introduced in 2015 – researchers today can query millions of records in seconds. The open data movement has accelerated this shift: the USPTO’s PatentsView API, the EPO’s Open Patent Services (OPS), and platforms like The Lens now allow programmatic access to patent data at scale. Machine translation tools embedded in Espacenet and PATENTSCOPE have made non-English patents searchable in a way that was previously impossible for most users. And the integration of AI-based tools in commercial platforms is steadily improving the precision of both patent and NPL searches. For students and practitioners in India, this means that a comprehensive prior art search – one that covers domestic patents via InPASS, international filings via PATENTSCOPE and Espacenet, and scientific literature via Google Scholar and The Lens – is now practically achievable without institutional subscriptions, at least at a preliminary level.
