The internet connects billions of people worldwide, yet unlike most global infrastructure, it operates without a single owner or central governing body. This unique structure raises fundamental questions about control, coordination, and responsibility. While the internet’s decentralized nature has fueled innovation and global connectivity, it also creates challenges in establishing consistent technical standards, resolving disputes, and addressing policy concerns that affect users across borders.

Understanding internet ownership

When we discuss internet ownership, we’re not referring to a single entity that possesses the entire network. The internet is fundamentally a network of networks, each owned and operated by different private companies, governments, educational institutions, and other organizations. No individual or entity owns the internet as a whole.

The internet relies on both physical and logical infrastructure. Physical components include undersea cables, satellites, data centers, and local network equipment owned by various entities worldwide. The logical infrastructure comprises IP addresses, domain names, and communication protocols that enable devices to connect and communicate. Managing this logical infrastructure is where questions of governance become most relevant.

The role of ICANN

In the absence of formal central authority, the Internet Corporation for Assigned Names and Numbers emerged as the organization with perhaps the most significant influence over internet coordination. ICANN is a private nonprofit organization established in 1998 by the United States government to manage critical internet resources.

Core responsibilities

IP address allocation: ICANN coordinates the distribution of IP addresses across five Regional Internet Registries that serve different geographical areas. These numerical identifiers allow devices to locate and communicate with each other on the network.

Domain Name System management: ICANN oversees the DNS, which translates human-readable domain names into IP addresses that computers use. This includes managing top-level domains like .com, .org, and country-code domains.

Root server system oversight: ICANN coordinates the operation of DNS root servers, which form the foundation of the internet’s addressing system.

Through its Internet Assigned Numbers Authority function, ICANN maintains internet standards, allocates internet numbers to different regions, and manages information related to top-level domains. The organization follows a bottom-up, consensus-driven, multistakeholder approach that involves governments, businesses, civil society, and technical communities.

Origins and US influence

ICANN’s creation reflected a desire by the US government to privatize internet management while maintaining some oversight. In January 1998, the US Department of Commerce issued the Green Paper proposing creation of a new nonprofit corporation to manage internet names and addresses. After receiving over 650 public comments, the government revised its approach in the White Paper, which led to ICANN’s incorporation in California in September 1998.

The organization initially operated under contract with the US Department of Commerce, which maintained final policy authority over the DNS root zone. This arrangement created tension with other nations who felt internet governance should be more internationally representative. The US government’s retention of oversight authority was perceived by the European Commission and other international actors as favoring American interests in what had become a global resource.

International tensions and governance debates

From its inception, ICANN faced criticism about legitimacy and representation. The European Commission would have preferred an institutional framework with a prominent role for public actors, but had to accept the US-directed privatization approach. This led to ongoing debates about whether internet governance should remain primarily technical or take a broader approach considering social, legal, and economic implications.

The revelations of mass surveillance by the US National Security Agency in 2013 intensified global concerns about American dominance of internet infrastructure. In response, the US announced in March 2014 its intention to transition oversight of IANA functions to the global multistakeholder community. On October 1, 2016, ICANN was finally freed from US government oversight, marking a significant shift toward international governance.

Alternative governance proposals

Some governments have advocated for moving internet governance to intergovernmental bodies like the United Nations, arguing this would provide more equitable representation. However, critics of this approach raise concerns about potential censorship and restrictions on internet freedom if certain authoritarian governments gained greater influence over internet policies.

The debate highlights fundamental tensions between different governance models. A 2021 study examining legitimacy perceptions found that while ICANN often ranks alongside or ahead of other global governance bodies, many elites remain unaware of ICANN, and participants in internet governance express only moderate confidence in the organization.

The need for coordination despite decentralization

While the internet is decentralized by design, certain functions require central coordination to ensure smooth operation. These include managing the limited pool of IP addresses, maintaining consistent DNS standards, and coordinating protocol parameters. Without such coordination, the internet could fragment into incompatible networks.

The challenge lies in balancing technical stability with policy concerns that reflect diverse values across cultures and political systems. Any governance structure must maintain the internet’s technical reliability while addressing legitimate questions about content, privacy, access, and representation. Purely consensus-based approaches involving hundreds of stakeholders can lead to decision-making paralysis, yet top-down control risks stifling the innovation that has made the internet successful.

Current governance landscape

Today’s internet governance involves multiple organizations with specialized functions. ICANN coordinates unique identifiers. The Internet Engineering Task Force develops technical standards. Regional Internet Registries manage IP address allocation in their territories. The Internet Governance Forum provides a platform for multistakeholder discussion of policy issues.

This distributed responsibility reflects the internet’s architecture, but it also creates complexity. Power and control in internet infrastructure is necessarily distributed between functionally-specific centers, regional technical communities, centrally-located networks, and national regulatory authorities. Despite common perception, the internet’s infrastructure has never been fully decentralized, nor was complete decentralization its primary design goal.

Looking forward

The question of internet ownership and governance continues to evolve. Recent geopolitical tensions have increased calls for internet fragmentation along national lines, threatening the global nature of the network. Meanwhile, emerging technologies like artificial intelligence and blockchain raise new governance challenges that existing structures may struggle to address.

For India and other developing nations, these governance debates carry particular significance. As internet penetration grows and digital economies expand, ensuring adequate representation in bodies that set global standards becomes increasingly important. The multistakeholder model offers opportunities for diverse participation, but it requires active engagement from all stakeholders to function effectively.
